1. Agreement to Terms

By accessing or using the NexStore platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. NexStore is operated from Malaysia and these terms are governed by the laws of Malaysia.

2. Description of Service

NexStore provides an e-commerce store builder platform that allows sellers to create and manage their own online stores. We offer store setup, hosting, design templates, seller dashboards, and related services as described on our website.

3. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 18 years old or have parental consent to use the Service.
• You are responsible for all activity that occurs under your account.
• NexStore reserves the right to suspend or terminate accounts that violate these terms.

4. Seller Responsibilities

• Sellers must comply with all applicable Malaysian laws and regulations, including the Consumer Protection Act 1999 and relevant e-commerce regulations.
• Sellers are responsible for the accuracy of their product listings, pricing, and descriptions.
• Sellers must not list prohibited, illegal, or counterfeit goods.
• Sellers are responsible for fulfilling orders and handling customer service for their stores.
• Sellers must maintain valid business registration (SSM) where required by Malaysian law.

5. Pricing & Payments

• All prices are quoted in Malaysian Ringgit (RM) unless otherwise stated.
• Our store setup plans are one-time payments as listed on our pricing page.
• Payments are non-refundable once store setup work has commenced, unless otherwise agreed in writing.
• Domain renewal fees are separate recurring costs borne by the seller.
• NexStore reserves the right to update pricing with reasonable notice.

6. Intellectual Property

The NexStore platform, including its design, templates, code, and branding, is the intellectual property of NexStore. Sellers retain ownership of their own content, product images, and store data. By using our templates, you are granted a non-exclusive, non-transferable licence to use them for your store.

7. Limitation of Liability

NexStore provides the platform on an "as is" basis. To the maximum extent permitted by Malaysian law, NexStore shall not be liable for any indirect, incidental, or consequential damages arising from the use of our Service. We do not guarantee uninterrupted service or that the platform will be error-free. Our total liability shall not exceed the amount paid by you for the Service.

8. Termination

Either party may terminate the service relationship with written notice. Upon termination, NexStore may retain your store data for up to 30 days before deletion. You may request a data export before your account is closed.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.

10. Changes to Terms

NexStore reserves the right to modify these Terms at any time. We will notify users of significant changes via email or through the platform. Continued use of the Service after changes constitutes acceptance of the updated terms.
